1. Acceptance of Terms

By accessing and using the UptimeFlux service operated by WebDigital France, you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.

2. Description of Service

UptimeFlux is a website and application monitoring service that:

• Monitors the availability and performance of websites, APIs, and services
• Sends alerts when issues are detected
• Provides status pages and uptime statistics
• Offers SSL certificate and domain expiration monitoring
• Provides API access for programmatic management

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts and Responsibilities

3.1. Account Creation

To use our Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2. Account Security

You agree to:

• Maintain the security of your password and identification
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
• Not share your account credentials with third parties

3.3. Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. Acceptable Use Policy

• Use the Service for any illegal or unauthorized purpose

5. Payment Terms

5.1. Subscription Plans

We offer various subscription plans with different features and limits. Pricing and plan details are available on our pricing page and may be updated from time to time.

5.2. Billing

Subscription fees are billed in advance on a monthly or annual basis. By subscribing to a paid plan, you authorize us to charge your payment method for the subscription fee.

5.3. Free Trial

We may offer a free trial period for paid plans. If you cancel during the trial period, you will not be charged. If you do not cancel before the trial ends, you will be charged according to your selected plan.

5.4. Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion in exceptional circumstances. Refund requests must be submitted within 14 days of the charge.

5.5. Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to paid features until the end of the billing period.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by WebDigital France and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

7. Service Availability and Uptime

While we strive to maintain high availability of our Service, we do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

• Scheduled maintenance
• Unscheduled maintenance or emergency repairs
• Technical failures or outages
• Force majeure events

We are not liable for any damages resulting from Service unavailability.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind
• We do not guarantee that the Service will be error-free, uninterrupted, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

You agree to defend, indemnify, and hold harmless WebDigital France and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service.
